1Scope and acceptance
Daakia Private Limited and/or its affiliates (“Daakia”, “we”, “our”, “us”) are committed to protecting the privacy of the people (“you”, “your”, “user”) who use the Daakia application, website and the services offered on them. This policy explains what we collect, why we collect it, who we share it with and the choices you have.
- This policy is part of the End User License Agreement (EULA) and should be read together with it. Capitalised terms not defined here have the meaning given in the EULA.
- By clicking “I Agree” and submitting your personal information, you accept this policy.
- If you are a minor, your information must be submitted by your parent or guardian, or by you with their permission. Doing so is treated as acceptance of this policy.
- This policy is provided in compliance with the Information Technology Act, 2000 (as amended), the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and, where applicable, the Digital Personal Data Protection Act, 2023.
2Changes to this policy
We are obliged to protect your information in line with applicable laws and regulations. This policy may change as our business and legal or regulatory requirements change. The latest version is always published on this page, and we will make reasonable efforts to tell you about significant changes. Please review this page from time to time.
3Information we collect
Personal information
Personal information is information that can identify you, such as your name, age, gender, contact details, and the products or services you are interested in. “Sensitive personal information” has the meaning given by applicable law from time to time.
We may collect:
- Account details such as your phone number, profile picture and, where relevant, your contact list, to provide the services and complete any transaction you request or authorise.
- Phone number for verification. We collect your number to send an SMS one-time password (OTP) so that sign-ups are verified, which helps keep junk and spam accounts out.
- Contacts permission (mobile app). The app asks for contact access so it can find and show contacts who already use Daakia, letting you start chats or calls with them.
- Information from applications and orders you submit when you apply for our products or services.
Non-personal information
Non-personal information is data that does not identify you, such as unique system or hardware identifiers, system or application software, and peripherals. We may collect diagnostic, technical and usage information. Where non-personal information is combined with personal information, we treat the combined data as personal information. You may opt out of sharing non-personal information at any time.
Location
With location settings enabled on your device, Daakia and its licensees and agents may collect information about your location and usage through Bluetooth, Wi-Fi signals and other technologies, to deliver the services and improve their design, functionality, performance and content. We may ask you to turn on location settings. Unless a service you request needs to identify you, location data is collected anonymously and in a form that does not identify you. By using Daakia you consent to this collection and processing of location data.
Cookies and similar technologies
Information collected through cookies and similar technologies is treated as non-personal information. Where local law treats IP addresses or similar identifiers as personal information, we treat anything linked to them as personal information too.
Other information
- We may collect other information in ways we describe to you or with your consent. You can choose not to provide some information, but this may limit the services you can use.
- When you install Daakia, we ask for device permissions it needs to work, for example to find your device’s location, access storage, and read basic phone status and identity.
- User Content. You may post profile information, status updates, comments, text, audio, video and media files. You keep ownership of your User Content. By sharing it through Daakia you allow others to view and share it as this policy describes.
- Invitations. If you invite friends by email or message, we may collect the recipient’s email address or contact details or third-party account username.
- Meetings and events. Daakia lets you host meetings, conferences, classes, webinars and virtual events, once meetings are created and joined by participants.
4How we use information
We use your information to:
- validate and process your requests for Daakia services or information;
- improve the quality of Daakia;
- help you decide which services best meet your needs;
- run our internal business operations, including meeting legal and regulatory requirements;
- recommend services you may be interested in, based on how you use Daakia;
- send marketing communications and advertising we believe may interest you (you can opt out at any time);
- process your purchases and carry out other activities needed to provide the services.
Contacts. If you allow contact permission in the mobile app, that data is used only to find and show contacts who are already on Daakia. Contact data is encrypted, which means we cannot read it, and we do not share your personal or contact information with any third party or application.
Non-personal information is gathered periodically to provide and improve Daakia, deliver software updates, product support and other services, and to check compliance with this policy.
6How long we keep information
We keep personal and non-personal information only for as long as needed to fulfil the purposes in this policy, unless a longer period is required or permitted by law. Once the purpose is met, the information is deleted in a safe and secure manner.
7End-to-end encrypted data
Your instant messages, media and files are processed only on your device and your recipient’s device. Before this data reaches our servers it is encrypted with a key known only to you and the recipient. Our servers carry this encrypted data to the recipient, but we cannot decipher it. We neither store nor process your personal data in this case, only random sequences of symbols that have no meaning without keys we do not hold.
8AI translation
Daakia uses Artificial Intelligence and Neural Machine Learning (AI & NML) to translate messages so people who speak or understand different languages can communicate.
- Translations may not always be exact or precise.
- Translation is a tool to break language barriers and is not endorsed by Daakia.
- Anything you do based on a translated message is your own responsibility.
- Translated messages are only displayed. They are not saved on your device, and Daakia does not save messages, translated or otherwise.
9Third-party services
Your mobile service provider, device operating system, pre-installed or third-party apps, social media platforms and websites you visit may also collect, use and share information about you and how you use them. We cannot control how they do so. Please read their own privacy policies.
Daakia may link to other websites or apps, or show third-party advertisements and content that link to them. Those services are governed by their own privacy policies, which may differ from ours. Once you leave our servers, how your information is used is up to the operator of that site or app. If you can’t find their policy on their homepage, contact them directly.
10Your choices and rights
You can ask us to access, correct, update or delete your personal information, and you can withdraw consent you have given. To do any of these, write to us at contact@daakia.co.in.
- Keep your information accurate. You are responsible for making sure what you give us is correct and current, and that you have the right to provide it.
- Effect of deletion or withdrawal. Deleting information or withdrawing consent may end your access to Daakia or to certain features.
- When we may not be able to act. We may be unable to process a request that is not backed by valid documents, that conflicts with a legal retention requirement, law-enforcement request or judicial proceeding, that is extremely difficult to implement (such as requests about backup copies or needing a new system), or that risks other users’ privacy.
- Opt out. You may opt out of sharing non-personal information and of marketing communications at any time.
11Security and storage
We use reasonable security measures, at a minimum those required by the Information Technology Act, 2000 and the 2011 Rules, to protect your data against unauthorised access and unlawful interception. Sending unencrypted information over the internet, cellular data or Wi-Fi carries inherent risk, which you accept. We are not responsible for a security breach or disclosure of personal information unless we have been grossly and wilfully negligent.
We are not responsible for loss, damage or misuse of your information caused by a Force Majeure Event, meaning any event beyond our reasonable control, including sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage devices, computer crashes, and breaches of security and encryption.
12Questions and complaints
We are committed to protecting the personal information we collect and process. For feedback or concerns about how your information is handled, write to us at contact@daakia.co.in. Our team will respond within 2 working days.
